The San Luis Obispo Child Support Services Department provides services to establish paternity, establish child support and medical support orders, enforce or modify child support and medical support orders, collect and distribute child support and spousal support payment, and close child support cases. The mission of the San Luis Obispo County Department of Child Support Services is to ensure that children receive the support to which they are entitled. The Department of Child Support Services establishes paternity and court orders for child and medical support, and enforces these court orders by collecting support from non-custodial parents. We encourage both parents to be involved in the lives of their children.
Child support is determined using child support guidelines established by California law. Child support guidelines are based on each parent's monthly income and the amount of time the child is cared for by each parent. In determining child support payments, the San Luis Obispo court will consider income from all sources. California Family Code Section 4050 states, "In adopting the statewide uniform guideline provided in this article, it is the intention of the Legislature to ensure that this state remains in compliance with federal regulations for child support guidelines." California Family Code Section 4052 states, "The court shall adhere to the statewide uniform guideline and may depart from the guideline only in the special circumstances set forth in this article." The principals the court must adhere to in implementing the statewide uniform guideline for child support calculation can be found in California Family Code Section 4053 (a)-(l).
