Uncontested Divorce - Uncontested Divorces California
Each divorce or dissolution of marriage has some uniqueness and can involve many complex issues.
While there can be many issues in a divorce, the most common issues are (1) division of property, (2) division of debt, (3) custody of children, (4) child support and/or spousal support.
The cost of a divorce will often be driven and proportional to the amount of issues that need to be worked out between the parties and the level of conflict between the parties. The more issues that need to be worked out and the higher the level of conflict the higher the cost of the divorce will likely be. It is beneficial to parties of a divorce to set their emotions aside and attempt to work out with each other as many issues as possible and avoid involvement of the family courts. However, not all parties will be able to work out their disagreements
A divorce is considered uncontested when the parties of the divorce agree on each and every issue related to the ending of their marriage. While most all disputes between the husband and wife are resolved outside of the courtroom in an uncontested divorce, it does not necessarily mean that the divorce was amicable. Uncontested divorces generally move much faster through the family court system and are generally far less expensive than a contested divorce. In this case, the parties generally do not even need to go to court. They can simply sign a Marital Settlement Agreement or Stipulation for Judgment, which is then incorporated into the Judgment and submitted to the court.
Because there can be very important legal ramifications to any particular divorce agreement, you may want to consult a divorce attorney for legal advice to determine where you stand legally with the terms of your divorce agreement and if there are any potential legal ramifications for entering into such an agreement. Also, with the drafting of orders and/or your final judgment of divorce, an attorney can help you review your divorce papers before filing.
