Legal Separation
A legal separation refers to when a couple wants to live apart from each other but does not want to officially divorce.
A legal separation does not terminate a marriage or domestic partnership. In other words, the couple’s marital status remains in tact while other marital issues such as child custody and visitation, child support, spousal support or alimony, and division of property have been resolved.
A legal separation can occur if a couple asks the court or judge for a legal separation order. The couple may file for a legal separation and file an amended petition for a divorce at a later time when all residency requirements are met. You do not need to meet the residency requirements in California to file for legal separation but you do for divorce. Couple’s or spouses who are separated cannot marry since they are not considered unmarried single person.
