Collaborative Divorce (or Collaborative Family Law, Collaborative Practice, Collaborative Law) was developed in the early 1990's by a Minnesota family lawyer and collaborative family law practitioner named Stuart G. Webb. Attorney Stu Webb wanted to come up with a different way to structure the family law practice, which would focus entirely on "collaboration" between divorcing parties in order to eliminate the frustration, distress, and high cost of divorce that would often occur in standard divorce litigation.

Collaborative divorce and collaborative family law is an altenative dispute resolution process intended to resolve family law issues without going to court. The collaborative divorce or collaborative family law approach may include the use of a collaborative divorce attorney or collaborative divorce lawyer for each party as well as neutral mental health professionals and neutral financial experts to support the family and guide the divorcing parties to mutually acceptable resolutions. Collaborative divorce California or collaborative law California can provide divorcing parties with complementary resources and altenative dispute resolution methods not typically available in family court litigation -- and legal counsel and financial guidance typically not present in divorce mediation.

Collaborative California Divorce & California Collaborative Law
California has recognized the collaborative law process as an alternative dispute resolution method for resolving family law disputes. California Family Code Section 2013 permits parties to avoid the adversary judicial mechanism. Local family court rules may allow divorcing parties to elect the collaborative law process by filing a Stipulation with the family court notifying the family court of the divorcing parties collaborative law process election.

California Family Code Section 2013. (a) If a written agreement is entered into by the parties, the parties may utilize a collaborative law process to resolve any matter governed by this code over which the court is granted jurisdiction pursuant to Section 2000. (b) "Collaborative law process" means the process in which the parties and any professionals engaged by the parties to assist them agree in writing to use their best efforts and to make a good faith attempt to resolve disputes related to the family law matters as referenced in subdivision (a) on an agreed basis without resorting to adversary judicial intervention.
