Annulment or Nullity of Marriage in California
An annulment ("nullity," "nullity of marriage," or "nullity of domestic partnership") occurs when a marriage or domestic partnership is legally invalid.
For example, a marriage or domestic partnership will likely be deemed invalid or void in cases of incestuous or bigamous. The following are other examples of when a marriage or domestic partnership may also be declared void:

• Fraud, physical or mental incapacity or mental retardation, or insanity
• One of the spouses or partners was too young to legally marry or enter into a domestic partnership
• One of the spouses or partners was already married (bigamy) or in a registered domestic partnership

When a marriage or domestic partnership is annulled certain rights given through a marriage may be lost. Some rights that may be lost through an annulment may be as follows:

• Marital property rights
• Succession or estate rights when other parent is deceased
• Spousal support or alimony
• Father’s guardian rights

An annulment is different from that of a divorce because a divorce occurs when the marriage was valid. However, child custody and support may still be an issue to address in annulment cases. Annulments of marriage are generally infrequent, but the legal process to have a marriage or domestic partnership annulled or voided is available for those that meet the criteria.
