YOUR USE OF THE CUSTODY MATCHING SERVICE (HEREINAFTER REFERRED TO AS THE "SERVICE") AND THE CUSTODYMATCH.COM WEB SITE (HEREINAFTER REFERRED TO AS THE "WEB SITE"), CONSTITUTES YOUR AGREEMENT TO BE BOUND BY THESE TERMS AND CONDITIONS OF SERVICE AND THE TERMS AND CONDITIONS OF USE. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS OF SERVICE AND THE TERMS AND CONDITIONS OF USE, YOU MUST NOT USE OR MUST IMMEDIATELY TERMINATE YOUR USE OF THE WEB SITE AND SERVICE.
CUSTODY MATCH MAY UPDATE THIS AGREEMENT (TERMS AND CONDITIONS OF USE AND TERMS AND CONDITIONS OF SERVICE) AT ANYTIME AND WILL POST THE UPDATES ON THE WEB SITE.
Availability - Limited Advertising Space is Available
Our objective is to provide a reasonable selection of family law attorneys to consumers (End User) seeking a family law attorney in the Southern California (Districts 6, 7, 8 and 9). Other factors such as specialization, years of experience, and attorney fees may also be taken into account. Ultimately, consumer demand determines how many attorneys will be included in our consumer and attorney matching system. Quantities available are subject to change at any time without notice.
Prioritization - Search Results Listing Order
Consumers who present their case at Custody Match will see attorney listings within the search results in random order. The top 3 positions can be reserved for an additional fee equal to 100%, 75% and 50% of your monthly advertising fee and is subject to availability. After the premium positions, the listings appear in regular prioritization order.
You will keep your prioritization positioning in the listings as long as you remain an advertiser in good standing, with all fees paid in full on time. If you sell your law practice, the new firm attorney can acquire your priority status if he or she meets all qualification and acceptance criteria of the Directory at that time.
We will not allow out-of-area attorneys to advertise in Southern California counties they do not have offices in or do not practice regularly in. If a large part of your experience and practice is not family law, you are not eligible for this service.
Attorneys are highly encouraged to be responsive to cases presented to them by consumers for two reason. One, it is advantageous to you because consumers know you have taken the time to read their case and are more likely to follow up with you. Two, responding to such cases typically builds good-will between you and your potential client. If you do not plan to respond to cases presented to you, do not use this service.
Complete profiles with photos are highly encouraged. Profiles with photos tend to stand-out and typically (not always) draw more interest from consumers. Attorney is responsible for keeping his/her profile up-to-date and complete. Those not meeting our standards will receive notice to complete their listing.
Recurring monthly contracts billed to your credit card each month unless specified differently in your contract. Your term starts once you’ve been accepted, contract has been completed and received, payment has been made in full, and your profile is "published" thus being accessible to consumers.
Currently there is no application fee. Qualification process includes bar record validation, Profile evaluation and advice on editing, and system programming. Custody Match reserves the right to use its discretion in determining whether or not you meet the qualifications for acceptance.
Initial Setup Fee
If your application fee is approved for membership there is a one-time initial setup fee. The setup fee covers the development, design, and programming costs associated with building your web page, banner, profile, and making you active in the Custody Match system.
The monthly fee to advertise is based on the demand in the geographic market area and available upgrades you request, less applicable discounts. Prices and rates are subject to change at any time. You will be given notice of any rate increases or decreases.
Each attorney in the same law firm and working from the same office location must qualify and be accepted individually and will have a separate Profile.
The following terms must be met to be accepted into the Directory:
1. Availability: There must be a current opening available in the geographic area you request.
2. Recommendation: During the interview, your specific legal experience and expertise will be discussed. Account Managers are instructed to match attorneys to available openings in a manner to ensure good coverage of sub-categories, experience, and fee level. Also important is the overall impression gained regarding professionalism and customer service.
3. Application: You must provide all requested information including complete biographical information as indicated in the Profile. Also required is a high-quality digital photograph.
4. Background Check: Custody Match checks for a valid license in each practice state and verification of good standing in state bar associations. Any past disbarments and suspensions (with possible exceptions for technical violations or nonpayment of dues) will disqualify an applicant.
5. Declaration: Your advertising contract with Custody Match will include a statement from you regarding any past disbarment or suspension by any bar association in any jurisdiction at any time in the past.
6. Future Actions Notification: You agree to notify Custody Match within three business days if you are the subject of any disciplinary action taken by any bar association. You agree to notify Custody Match within three business days if you are the subject of mandatory fee arbitration case.
7. Custody Match Pledge: Your advertising contract will also include a pledge to clients reflecting our service standards.
All fees will be debited from a prearranged accepted credit or debit card upon application and monthly thereafter after your ad is published. Invoices and other payment methods are not available.
There are no refunds for services rendered or advertising unless otherwise stated in your advertising contract.
Custody Match reserves the right to terminate your advertisement at any time by providing you with notice and a prorated refund. This could occur if:
Severability of Provisions
These Terms and Conditions of Use incorporate by reference all notices and disclaimers contained on the Web Site and constitute the entire agreement between you and Provider with respect to access to and use of the Web Site. If any provision of these Terms and Conditions of Use is found unlawful, void or unenforceable, then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.
Provider reserves the right to change these Terms and Conditions of Use at any time. Updated versions of the Terms and Conditions of Use will appear on this Web Site and are effective immediately. You are responsible for regularly reviewing the Terms and Conditions of Use. Continued use of the Web Site after any such changes constitutes your consent to such changes.
These Terms of Service will be governed by and construed in accordance with the laws of the State of California, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect. These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by THE WEB SITE and SERVICE.
