California appellate law is an area of law that has to do with procedural and practical aspects of matters before state and federal appellate courts such as The United States Supreme Court, the California Supreme Court, the federal Court of Appeals, the California Court of Appeal or a similar appellate court. A California Appellate Law Specialist is certified by the California State Bar Board of Legal Specialization as a specialist in the practice area of appellate law and will have demonstrated a commitment to the highest standards of legal competence in the field.

What are the Standards to be a California Certified Appellate Law Specialist or California Appellate Law Specialist Attorney?

The California State Bar has a special program for certifying attorneys in the specialty area of Appellate Law. In order for an attorney to be considered for certification as an Appellate Law Specialist by the California State Bar Board of Legal Specialization, he/she will have to meet certain task and educational requirements in addition to passing a written exam, demonstrating a high level of experience and be favorably evaluated by other attorneys and judges familiar with the attorney's work.

Within five years immediately prior to submission of the written application, an applicant must demonstrate that he/she has been substantially involved in the practice of appellate law – Proving he/she has been substantially in tasks such as advising clients with regards to appeals, identifying appealable orders, designating, reviewing and evaluating the record, preparing briefs, appellate motions, petitions for extraordinary writ, petitions for review, habeas corpus petitions and presenting oral arguments. With respect to each task, the applicant must have performed the task personally.

An applicant must also show that, within the three years immediately prior to submission of the application, he/she has completed a minimum of 45 hours of approved educational activities as follows:

(1) Not less than 20 of the required hours must be in appeals and writs
(2) The remaining hours may be in any combination of pre-trial, trial, or post-trial practice and procedure, or substantive law topics

Approved educational activities for the purposes of this section, may include educational activities approved for either MCLE or legal specialist credit.

Appellate Law Specialist Certification is for a five-year period. In order for a California Appellate Law Specialist to be re-certified, he/she must continue to meet task, educational and peer review requirements comparable to those for the original certification.

An applicant up for recertification must show that during the current five-year certification period, he/she has had direct and substantial involvement in the practice area of appellate law demonstrated by complying with certain requirements similar to that of the original certification. At the discretion of the Commission, the task requirement may be deemed fulfilled by statement showing that the applicant has engaged in the practice of appellate law substantially to the same extent as described in the application for original certification.

An applicant up for recertification must also show that during the current five-year certification period he/she has completed not less than 60 hours of approved educational activities as follows:

(a) Not less than 25 of the required hours must be in appeals and writs
(b) The remaining hours may be in any combination of pre-trial, trial, or post-trial practice and procedure, or substantive law topics

Approved educational activities for the purposes of this section, may include educational activities approved for either MCLE or legal specialist credit.

The Standards must be read in conjunction with the Rules Governing the State Bar of California Program for Certifying Legal Specialists, which govern the Program requirements.
